Opposition and cancellation
- Opposition:
Where a trademark application has been preliminarily approved by the Trademark Office and published in the Trademark Gazette any legitimate party may file an opposition against the application within 3 months as of the publication date.
- Filing Requirement:
- 1. Power of Attorney
- 2. Copy of the business license or extract from commercial register if the applicant is a legal entity or copy of the identification card/passport if the applicant is a natural person
- 3. Application Form
- 4. Preliminary evidence showing the opponent's stake in the registration of the published mark (further evidence can be filed later)
- Cancellation:
Where a registered trademark is becoming a generic name in a category of approved goods, or the mark has not been used for a period greater than 3 years without any justifiable reasons, any organization or individual may request that the Trademark Office make a decision to cancel such registered trademark.
